Realty Data Systems, LLC, the property inspection company that in April accused disgraced Freeholder John P.Curley of corruption and official misconduct, said they became aware of new evidence of Curley’s malfeasance this month.
Michael Panter, one of RDS’s founders and owners acting as the company’s in-house lawyer, made the new allegations against Curley in a Notice of Claims filed with Monmouth County Counsel Michael Fitzgerald and County Administrator Teri O’Connor on Thursday October 25. The notice includes a draft lawsuit against the County of Monmouth as Curley’s employer.
Curley is accused of Civil Conspiracy, Negligence, Tortious Interference with a Contract and Tortious Interference of Prospective Economic Advantage.
RDS claims that Curley, along with Monmouth County Tax Board Commissioner Wayne Pomanowski and a yet to be named attorney, conspired to deceive the public for the economic benefit of the attorney and the political and economic gain of Curley.
The “anonymous” letter alleging corruption within the ADP pilot program which modernized they way New Jersey homes are valued for property tax purposes that Curley distributed in 2015 and 2016 was actually written by the “John Doe” attorney. The attorney’s tax appeal revenue dropped off by 70% due to the ADP program. Curley is accused of knowing the identity of the letter’s author when he represented it as anonymous and distributed it to the Asbury Park Press, More Monmouth Musings and the Monmouth County Prosecutor.
Curley and Pomanowski are accused to putting pressure on municipal officials, clients and prospective clients of RDS, to withdraw from the ADP program.
RDS claims that Curley’s dishonesty in this matter has already cost Monmouth County taxpayers over $1 million. RDS losses were listed as at least $230,000 is lost revenue, in addition to unspecified expenses incurred to fight off the damage done by the false allegations.
Curley became aware of RDS’s claim on Thursday, October 25. He has not responded to request for comment.
Pomanowski is accused of emailing municipal officials, clients and prospective clients of RDS, at Curley’s direction, on August 10, 2016, encouraging them to “DO NOT BECOME A SPOKESMAN FOR THE [ADP] TAX PROGRAM”, and stating that if an individual did so, he would “expose himself to the rage of Freeholder Curley.” These emails further advised the municipal official that “being proactive versus Reactive will stir controversy with out [sic] Freeholder” and “DO NOT GET INTO THE PLUSES AND MINUSES OF THE ADP. heed my advice.”
Pomanowski told MMM he did not recall sending such emails and could not locate such emails in his archives. He said, “John Curley does not tell me what to do. Never has and never will.” Pomanowski further stated that he was a supporter of the ADP program.
